1.1 What We Provide

• AI-powered answer generation using Anthropic Claude
• Document parsing (PDF, DOCX, TXT formats)
• Excel questionnaire support (.xlsx)
• Confidence scoring and review recommendations

1.2 What We Do Not Provide

• Legal, compliance, or security consulting services
• Guarantee of answer accuracy or completeness
• Manual review or validation of answers
• Liability for decisions made based on generated answers

IMPORTANT: The Service uses artificial intelligence to generate answers. While we strive for accuracy, AI-generated content may contain errors, inaccuracies, or hallucinations. You are responsible for reviewing and verifying all answers before submission.

2. Account Registration and Eligibility

2.1 Eligibility

To use the Service, you must:

• Be at least 18 years of age
• Have legal capacity to enter into binding contracts
• Not be prohibited from using the Service under applicable law
• Provide accurate and complete registration information

2.2 Business Use

The Service is intended for business and professional use. If you are using the Service on behalf of an organization:

• You represent that you have authority to bind that organization to these Terms
• "You" refers to both you as an individual and the organization

3. Subscription Plans and Billing

3.2 Free Trial

• New users receive 1 free questionnaire to evaluate the Service
• No credit card required for free trial
• Free tier limitations apply (200 rows, 10MB KB)
• After using the free questionnaire, you must subscribe to continue

3.3 Billing Terms

• Subscriptions are billed monthly in advance via Stripe
• Charges are non-refundable except as required by law
• You authorize us to charge your payment method for all fees
• Prices are in Euros (EUR) unless otherwise stated
• VAT will be added where applicable

3.4 Automatic Renewal

• Subscriptions automatically renew each month unless cancelled
• You will be charged on the renewal date
• You can cancel at any time before the next billing cycle
• Cancellation takes effect at the end of the current billing period

3.5 Usage Limits

• Monthly limits reset on the 1st of each month (calendar month basis)
• Usage is tracked per account (not per billing cycle)
• Exceeding limits will prevent processing until next month or upgrade
• Unused quota does not roll over to the next month

3.6 Price Changes

• We may change subscription prices with 30 days' advance notice
• Price changes apply on your next renewal date
• You may cancel if you do not accept the new price
• Existing subscriptions continue at current price until renewal

4. Acceptable Use Policy

4.1 Permitted Uses

You may use the Service to:

• Process legitimate business questionnaires
• Upload your organization's documentation as knowledge base
• Generate draft answers for review and verification
• Evaluate and improve compliance processes

4.2 Prohibited Uses

You may NOT use the Service to:

• Illegal activities: violate any laws, regulations, or third-party rights
• Harmful content: process content that is defamatory, discriminatory, harassing, or promotes violence
• Unauthorized access: attempt to access other users' data or accounts
• System abuse: reverse engineer, decompile, or attempt to extract source code
• Excessive use: submit automated requests, scraping, or DDoS attacks
• Reselling: resell, sublicense, or rent the Service without authorization
• Circumvention: attempt to bypass usage limits or security measures
• False information: create fake accounts or provide fraudulent payment information
• Competitive purposes: use the Service to build a competing product
• Sensitive personal data: process special category data (health, biometric, genetic) without proper legal basis

4.3 Consequences of Violation

Violation of these Terms may result in:

• Immediate termination of your account
• Forfeiture of any prepaid fees
• Legal action to recover damages
• Reporting to law enforcement if criminal activity is suspected

5. Intellectual Property Rights

5.1 Your Content

• You retain all ownership rights to content you upload (KB documents, questionnaires)
• You grant us a limited, temporary license to process your content for the sole purpose of providing the Service
• This license terminates when files are deleted (immediately after processing)
• You represent that you have all necessary rights to upload and process the content

5.2 Service Intellectual Property

• The Service, including all software, designs, text, graphics, and trademarks, is owned by us or our licensors
• These Terms do not grant you any ownership rights in the Service
• You may not copy, modify, distribute, or create derivative works without permission

5.3 AI-Generated Content

• Answers generated by the Service are not guaranteed to be original or free from third-party rights
• You are responsible for ensuring compliance with applicable laws when using generated content
• We do not claim ownership of AI-generated answers
• You should verify that generated content does not infringe third-party rights before use

5.4 Feedback

• If you provide feedback, suggestions, or ideas about the Service, we may use them without obligation or compensation to you

6. Data Processing and Privacy

6.1 Privacy Policy

• Our collection and use of personal data is governed by our Privacy Policy
• By using the Service, you consent to data processing as described in the Privacy Policy

6.2 File Retention

• Uploaded files (KB documents and questionnaires) are automatically deleted immediately after processing
• Maximum retention: 15 minutes (Vercel cleanup fallback)
• We do not store questionnaire content long-term
• Usage metadata (row counts, timestamps) is retained for billing and analytics

6.3 AI Processing

• Your KB documents and questionnaires are sent to Anthropic (Claude AI) for processing
• Anthropic does not use API data for training AI models
• Anthropic retains data for up to 30 days for trust & safety, then deletes it

6.4 Security

• We implement industry-standard security measures (HTTPS, encryption, access controls)
• However, no system is 100% secure - you acknowledge this inherent risk
• You are responsible for backing up important data before processing

7. Service Availability and Support

7.1 Uptime and Reliability

• We strive for high availability but do not guarantee uninterrupted access
• The Service may be unavailable due to:
  • Scheduled maintenance (we will provide notice when possible)
  • Technical issues beyond our control
  • Third-party service outages (Anthropic, Vercel, Stripe, etc.)
  • Force majeure events

7.2 Service Modifications

• We may modify, update, or discontinue features at any time
• We will provide reasonable notice of material changes when possible
• Continued use after changes constitutes acceptance

• Answers are suggestions only and require human review and verification
• We do not guarantee that answers are accurate, complete, or compliant with regulations
• You are solely responsible for reviewing, editing, and verifying all generated content before use

8.3 No Professional Advice

• The Service does not provide legal, compliance, security, or professional consulting advice
• Generated answers should not be relied upon as professional guidance
• You should consult qualified professionals for critical compliance decisions

8.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Our total liability for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim (or €100 if no payment was made)
• We are not liable for:
  • Indirect, incidental, consequential, special, or punitive damages
  • Lost profits, revenue, data, or business opportunities
  • Costs of procurement of substitute services
  • Regulatory fines, penalties, or legal actions resulting from use of generated content
  • Damage caused by third-party services (Anthropic, Stripe, etc.)

8.5 Exceptions

Nothing in these Terms excludes or limits our liability for:

• Death or personal injury caused by our negligence
• Fraud or fraudulent misrepresentation
• Any liability that cannot be excluded under applicable law

9. Indemnification

You agree to indemnify, defend, and hold harmless SecQuestionnaires, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any law or third-party rights
• Content you upload or process
• Decisions made based on AI-generated answers
• Claims that your content infringes third-party intellectual property rights

10. Termination

10.1 Termination by You

• You may cancel your subscription at any time via account settings
• Cancellation takes effect at the end of the current billing period
• No refunds for partial months
• You may delete your account by contacting support

10.2 Termination by Us

We may suspend or terminate your account immediately if:

• You violate these Terms or Acceptable Use Policy
• Your account is involved in fraudulent or illegal activity
• Required by law or court order
• You fail to pay fees when due
• We discontinue the Service (with 30 days' notice)

10.3 Effect of Termination

Upon termination:
